Dell Beats Quarterly Estimates After Cost Cuts Despite 20 Percent Drop in Revenue

Better cost controls helped Dell Technologies beat estimates for first-quarter profit on Thursday, a positive sign for personal computer makers after months of cratering demand.

The results contrasted rivals HP and Lenovo Group, but a full recovery remains some ways off as Dell forecast current-quarter revenue below Wall Street targets and warned that IT spending would stay cautious.

Shares of the company were down 2 percent after the bell, reversing gains of 5 percent. The stock was briefly halted during regular trading hours when the company announced results earlier than scheduled.

"We maintained pricing discipline, reduced operating expenses, and our supply chain continued to perform well after normalizing ahead of competitors," said Chuck Whitten, co-chief operating officer of Dell.

Total operating expenses fell 6 percent to $3.57 billion (roughly Rs. 28,826 crore) during the first quarter.

The company's revenue dropped 20 percent to $20.92 billion (roughly Rs. 1,72,30,339 crore) but came in above analysts' expectations of $20.27 billion (roughly Rs. 1,66,91,838 crore), according to Refinitiv data.

Demand for desktops and laptops slumped after a pandemic-driven rush for work-from-home equipment, leading to a pile-up in inventory amid an uncertain economic outlook.

Dell's client solutions unit - home to its consumer and enterprise PC business - posted a 23 percent fall in sales, while the infrastructure solutions unit, which includes servers, storage devices, and networking hardware, saw an 18 percent decline.

Excluding items, Dell earned $1.31 (roughly Rs. 108) per share, compared with estimates of 86 cents.

The Texas-based company expects second-quarter revenue to be between $20.2 billion (roughly Rs. 166,31,892 crore) and $21.2 billion (roughly Rs. 1,74,55,126), below expectations of $21.2 billion (roughly Rs. 1,74,55,126) at the midpoint.

Google’s Wear OS Adding New Spotify, Notes Tiles Along With Wallet Support for Transit Cards: All the Details

Some of the Wear OS-related announcements made at the recent Google I/O 2023 event now appear to be ready as the search giant just announced that it would be adding new features to its smartwatch platform, which will soon be upgraded to Wear OS 4. Google has announced that the Spotify and Keep apps on Wear OS will be getting new tiles along with additional functionality for its Google Wallet app, for users in the US. The updates for the same will be available via their respective apps for users in the coming weeks.

Among several other features coming to Android, Google in its latest feature drop announced that the Spotify app for Wear OS will be getting three new tiles. The three tiles are for podcasts, tracks on heavy rotation, and an AI-enabled DJ feature. The DJ feature will automatically generate a lineup of songs, stream episodes and podcasts, which will be personalised for the user.

Google's Keep note taking app on Wear OS also gets a much-needed update letting users add multiple tiles. These tiles are customisable in the sense that they can be pinned notes or even to-do lists. Adding notes or lists as tiles obviously makes it easier to glance through them with a single swipe from the watch face.

Also added for US users (primarily in Washington DC and the San Francisco Bay Area) is the ability to tap and ride. Commuters with a Wear OS smartwatch can simply scan the watch to pay using their SmartTrip and Clipper cards via Google Wallet.

The above updates are expected to work on all Wear OS-powered devices and not just Google's Pixel Watch, which is only available in select markets globally.

Google at its recent I/O 2023 developer event announced several new features that will be coming to the latest version of smartwatch operating system called Wear OS 4. The big update that is expected to roll out in the coming months to Pixel Watch users will bring a lot more functionality to such smartwatches by adding services like Gmail, Calendar, and Google Home as well. The update is also said to bring features like WhatsApp call support once the platform successfully brings its native app to Wear OS. The app is currently available in a beta state only.

Also expected with Wear OS 4 are battery life improvements and the ability to create backups and restore them to other watches. There's also a new Watch Face Format, which has been developed in partnership with Samsung, which will help developers create more uniform watch faces for the platform with ease and a level of consistency.

Google I/O 2023 saw the search giant repeatedly tell us that it cares about AI, alongside the launch of its first foldable phone and Pixel-branded tablet. This year, the company is going to supercharge its apps, services, and Android operating system with AI technology. We discuss this and more on Orbital, the Gadgets 360 podcast. RBI Deputy Governor Asks Banks to Gear for Blockchain Future as India Awaits Crypto Rules

Mahesh Kumar Jain, the Deputy Governor of the Reserve Bank of India (RBI), has predicted that technologies like blockchain and Artificial Intelligence (AI) would be part of the future of finance. The RBI recently met with the directors of Indian banks. The aim of this meeting was to address concerns and risk mitigation measures that India must be ready for in the future. The up-and-coming blockchain technology is the underlying system that supports cryptocurrencies, NFTs, and the overall Web3 sector.

Linking AI and blockchain to existing financial systems, the RBI official said, is essential to ensure the growth and stability of India's digital finance sector.

“Indian banks will need to focus on digital transformation, enhance customer experience, adopt innovative technologies such as AI and blockchain, invest in cybersecurity measures, look for opportunities to derive synergistic benefits through collaboration with other players as well as upskilling their workforce to meet the demands of the digital era,” Jain said in the meeting.

The development comes just days after a Coindesk report claimed that Indian crypto exchanges were in “survival mode” right now. Citing sources from CoinDCX, CoinSwitch, WazirX, BuyUCoin, ZebPay, and Giottus, the report claimed Indian exchanges see their runways ranging from 21 months to four years before they land into a bull market.

Speaking to Gadgets 360, Unocoin CEO Sathvik Vishwakarma agreed that the next four years are indeed crucial for India's crypto ecosystem and highlighted that progressing with tech is crucial for the nation to be ready for the hyper-competitive future.

“Regulatory environment, institutional adoption, tech advancement, market volatility, and investor sentiment are among several major factors that will shape the future of national as well as international fintech sector,” Vishwakarma said.

The Unocoin chief listed patchy policies, hack attacks on Web3 platforms, and resistance from traditional finance as factors that may delay the projected four-year trajectory, which may vary depending on the perspectives of industry insiders.

India's CoinDCX exchange also emphasised that it is prioritising tech development in order to keep its services up to date and relevant for the users.

“CoinDCX is using the bear market as an opportunity to build and enhance its technology. We are investing heavily in strengthening our capabilities and infrastructure to pave the way for the mass adoption of Web3,” the company told Gadgets 360.

For now, the RBI governor has asked banks to prioritise risk management, regulatory compliance, and sustainability solutions to ensure long-term resilience in the banking ecosystem.

ISMC $3-Billion India Semiconductor Plant Plans Stall as Intel Acquires Tech Partner Tower

A planned $3 billion (roughly Rs. 24,700 crore) semiconductor facility in India by chip consortium ISMC that counted Israeli chipmaker Tower as a tech partner has been stalled due to the company's ongoing takeover by Intel, three sources said, dashing India's chip making plans.

A second mega $19.5 billion (roughly Rs. 1,60,800 crore) plan to build chips locally by a joint venture between India's Vedanta and Taiwan's Foxconn is also proceeding slowly as their talks to rope in European chipmaker STMicroelectronics as a partner are deadlocked, a fourth source with direct knowledge said.

The challenges faced by the companies deal a major setback to Prime Minister Narendra Modi, who has made chipmaking a top priority as he wants to "usher in a new era in electronics manufacturing" by luring global companies.

India, which expects its semiconductor market to be worth $63 billion (roughly Rs. 5,19,600 crore) by 2026, last year received three applications to set up plants under a $10 billion (roughly Rs. 82,500 crore) incentive scheme. They were from the Vedanta-Foxconn JV; a global consortium ISMC which counts Tower Semiconductor as a tech partner; and from Singapore-based IGSS Ventures.

The Vedanta JV plant is to come up in Modi's home state of Gujarat, while ISMC and IGSS each committed $3 billion (roughly Rs. 24,700 crore) for plants in two separate southern states.

Three sources with direct knowledge of the strategy said ISMC's $3 billion (roughly Rs. 24,700 crore) chipmaking facility plans are currently on hold as Tower could not proceed to sign binding agreements as things remain under review after Intel acquired it for $5.4 billion (roughly Rs. 44,500 crore) last year. The deal is pending regulatory approvals.

Talking about India's semiconductor ambitions, India's deputy IT minister Rajeev Chandrasekhar told Reuters in a May 19 interview ISMC "could not proceed" due to Intel acquiring Tower, and IGSS "wanted to re-submit (the application)" for incentives. The "two of them had to drop out," he said, without elaborating.

Tower is likely to reevaluate taking part in the venture based on how its deal talks with Intel pan out, two of the sources said.

ISMC consortium partners Next Orbit Ventures did not respond to a request for comment and Tower declined to comment. Intel also declined comment.

Singapore-based IGSS did not respond, and neither did India's federal IT ministry.

Setback for Vedanta

Most of the world's chip output is limited to a few countries like Taiwan, and India is a late entrant. Amid much fanfare, in September, the Vedanta-Foxconn JV announced its chipmaking plans in Gujarat. Modi called the $19.5 billion (roughly Rs. 1,60,800 crore) plan "an important step" in boosting India's chipmaking ambitions.

But things haven't gone smoothly as the JV tries to hunt for a tech partner. The fourth source said Vedanta-Foxconn had got on board STMicroelectronics for licensing technology, but India's government had conveyed it wants STMicro to have "more skin in the game" - like a stake in the partnership.

STMicro is not keen on that and the talks remain in limbo, the source added. "From STM's perspective, that proposal doesn't make sense because they want India market to first be more mature," said the person.

Deputy IT minister Chandrasekhar told Reuters during the May 19 interview the Vedanta-Foxconn JV was "struggling currently to tie up with a technology partner."

STMicro declined to comment.

In a statement, Vedanta-Foxconn JV CEO, David Reed, said they have an agreement with a technology partner to transfer technology with licenses, but declined to comment further.

In a move seen to revive investor interest, India's IT ministry on Wednesday said the country will start re-inviting applications for chipmaking incentives. This time the companies can apply until December next year, as opposed to the initial phase where there was only a 45 day window.

"It is expected that some of the current applicants will reapply and new fresh investors will also apply," minister Chandrasekhar said on Twitter.

FTX's Sam Bankman-Fried Could Be Planning to Blame Lawyers Who Helped Launch Firm in Criminal Case

Indicted FTX founder Sam Bankman-Fried seems to be gearing up to blame the lawyers who helped him establish the crypto exchange.

That's the subtext of a motion filed on Tuesday by his lawyers at Cohen & Gresser, who are defending Bankman-Fried against federal charges of fraud, conspiracy and bribery. They're asking for access to documents from Fenwick & West, the Silicon Valley law firm that represented FTX and sister hedge fund Alameda Research from the companies' inception through their collapse in November 2022.

Fenwick & West did not respond to my email queries. The firm has not yet filed a response to a civil suit by FTX customers who named Fenwick as a defendant.

Bankman-Fried has pleaded not guilty to the charges. The defense motion claims that Fenwick & West advised him, FTX and Alameda on at least four matters at the heart of the Manhattan federal court indictment against the onetime crypto billionaire.

The California law firm, for instance, allegedly provided counsel to FTX on the creation of shell companies that opened accounts at Silvergate Bank to receive deposits from FTX customers, according to Tuesday's motion. Those shell company bank accounts are a critical element of the government's bank fraud conspiracy charge.

Fenwick & West also allegedly advised FTX that it was not required to register with the U.S. government as a money transmitting business, according to the new motion. Prosecutors have charged Bankman-Fried with conspiring to violate wire transfer laws by failing to register but his lawyers said in the new motion that Fenwick's alleged advice “directly contradicts the government's theory.”

Bankman-Fried's filing similarly contends that Fenwick & West reviewed internal agreements in which Alameda loaned money to Bankman-Fried and other FTX executives. The government alleges that the loans were an illegal misappropriation of customer deposits as part of a scheme to violate federal campaign finance laws. Bankman-Fried's new motion argues that Fenwick & West's legal advice on the tax consequences of the loans might rebut the government's contention that the loans were improper.

Finally, the motion asserts that it was Fenwick that instructed Bankman-Fried to communicate with other FTX and Alameda executives via Signal and other ephemeral messaging apps. That alleged advice would undercut the government's claim that Bankman-Fried directed his colleagues to use Signal and other encrypted communication apps to hide evidence of his crimes.

Bankman-Fried's lawyers acknowledged in the motion that their assertions about Fenwick & West are based on a very limited set of documents.

The filing does not specifically invoke the words "advice of counsel" to refute government claims that Bankman-Fried acted with criminal intent. But Bankman-Fried's lawyers seem to be headed in that direction, telling US District Judge Lewis Kaplan of Manhattan that they need to know more about Fenwick's work for FTX and Alameda to determine if the law firm's documents exonerate their client.

Those documents could help Bankman-Fried later argue at trial that he was following advice from FTX's lawyers.

Tuesday's filing asks Kaplan to order the government to turn over evidence from Fenwick & West or to authorize Bankman-Fried to subpoena documents from the law firm.

The firm would almost certainly rather not turn over client files to Bankman-Fried. Among other reasons, Fenwick & West has been named as a defendant in a sweeping class action by FTX customers. The plaintiffs' lawyer who filed that case, Kerry Miller of Fishman Haygood, told me on Wednesday that he plans to monitor the Bankman-Fried criminal case for any Fenwick & West documents that might boost the class allegations.

Bankman-Fried's lawyers from Cohen & Gresser declined comment on the new motion through a spokesperson. The Manhattan U.S. Attorney's office also declined to comment.

Attorney-client privilege is often a complication for white-collar defendants who want to blame their companies' lawyers for providing bad advice. Companies – rather than individual executives or outside law firms -- control the right to insist that communications with their counsel remain confidential. Companies are typically reluctant to waive privilege for fear that their lawyers' documents might be used in other cases.

Bankman-Fried's new motion said his lawyers are in negotiations with FTX's new counsel about whether the company intends to assert attorney client privilege over relevant Fenwick & West documents. (The motion did not name FTX's new law firm but it is Sullivan & Cromwell.) Defense counsel also said that Fenwick & West told them it would not turn over any documents without FTX's permission.

The motion floats two theories for why Bankman-Fried is entitled to access to certain Fenwick & West communications even if FTX claims privilege. Bankman-Fried said the law firm represented him personally in addition to serving as counsel to FTX and Alameda. That assertion seems to hint that Bankman-Fried will claim that he can personally waive privilege over some Fenwick & West communications.

Defense lawyers also argued that FTX, which is in Chapter 11 bankruptcy, has already waived its privilege over certain documents by turning them over to prosecutors. If that's correct, said former federal prosecutor Harry Sandick of Patterson Belknap Webb & Tyler, it will be easier for Bankman-Fried to obtain Fenwick's communications.

“It's hard to see why the defense should be denied access,” Sandick said.

If Bankman-Fried's lawyers believe that Fenwick documents can help them refute the government's evidence of criminal intent, Sandick said, they will eventually have to make a strategic decision about how to get the law firm's communications in front of a jury.

The documents must be introduced through a witness – presumably Bankman-Fried himself or a Fenwick & West lawyer. The strongest defense case, Sandick said, would probably feature testimony from a Fenwick & West witness to bolster testimony from Bankman-Fried about his reliance on advice from FTX lawyers. But contradictory testimony from a law firm witness could undermine Bankman-Fried's advice-of-counsel defense.

That's a concern for another day. Right now, Sandick said, Bankman-Fried's lawyers just want to know whether Fenwick & West's files will help their client.

“It's an understandable motion,” he said. “They're saying, ‘Let's see what the documents say, then we'll decide how to use them.'”
